1. MARCHON™ Supplements – Terms of Service

WHO IS RESPONSIBLE FOR YOUR DATA?

Our Privacy Notice applies to the personal data that MARCHON collects and uses. References in this Privacy Notice to “MARCHON”, “we”, “us” or “our” means MARCHON Supplements Ltd (a company registered in England and Wales with registration no 13961244 and registered office at MARCHON Supplements Ltd: Miller & Co, 5 Imperial Court, Laporte Way, Luton, LU4 8FE). We control the ways your personal data are collected and the purposes for which your personal data are used and are therefore the “data controller” for the purposes of the GDPR 2018, UK Data Protection Act 2018 and any other applicable European data protection legislation.

WHAT INFORMATION DOES MARCHON SUPPLEMENTS COLLECT FROM ME?

We collect certain information from you when you share that information with us, when you use our website, attend our events, visit our stores or gyms, communicate with us such as by e-mail, phone call or text message, interact with us through social media, and when you purchase products from us.

  • Personal Information:

    • We may collect certain personal information you share with us, including, but not limited to, your name, company name, physical address, town, telephone number, birthday, gender, and email address.

    • If you create an account with us, we also collect your login and account information, including your username and password.

    • When you purchase products from us, we will additionally collect your billing address and shipping information.

    • We may collect information about your personal preferences including marketing and cookie preferences.

  • Website Visit Information: We also collect certain types of non-personal information whenever you visit our website. By “Site Visit Information” we mean information that does not directly identify you personally, such as IP address, device information, unique identifiers, and browser information.

  • Aggregate Information: Aggregate Information is information that does not identify you in any way. Aggregate Information may be collected when you visit our website, independent of any information you voluntarily enter. Additionally, we may use one or more processes to de-identify information that contains Personal Information, such that only Aggregate Information remains. WHAT DOES MARCHON SUPPLEMENTS DO WITH THE INFORMATION IT COLLECTS?

We will only use your information for the purposes for which we have collected it, or the purposes set forth in this Policy, unless you consent otherwise. We will not disclose your Personal Information to third parties other than as described in this Policy, unless you give us consent to do so.

  • Third Parties: We do not sell or lease your information to third-parties.Your information may be held by third parties or we may link to other sites or applications not affiliated, owned, or controlled by us. Further, we may use products and services of third parties, for which the disclosure of your information is necessary, to help us better provide our Services to you (such as Google Analytics, Shopify, and Facebook). We expressly disclaim any and all liability for the actions of third parties. The privacy practices of any third parties are outside the scope of this Privacy Policy and their use or disclosure of your information (including your personal information) will be governed by their own privacy practices or policies. We encourage you to review the privacy practices or policies of those third parties.

  • MARCHON Supplements’ use of your Personal, Analytics, and Site Visit Information: This information helps us operate our website, fulfill orders you place with us, and provide other services, including advertisements, ad serving, and technical support. We also use this information to suggest products and promotions to you, and to send you updates about our company, our events, and our initiatives.

  • MARCHON Supplements sharing of Personal, Analytics, and Site Visit Information: We may share this information with our service providers to assist us with operating our website, selling our products and services, our advertising, and our technical support. We also share Personal Information with third parties to help us provide products and services to you such as fulfilling and delivering orders and processing payments. In these situations, you are using and directing us to intentionally disclose Personal Information so our products and services and your requests can be provided to you.

  • Legal and Law Enforcement Requests: We may disclose, at our sole discretion, your Personal, Analytics and Site Visit information as required by law, or to comply with a legally binding request—such as a subpoena, warrant, or similar legally enforceable request for information.

  • Other Uses and Disclosures: We may also share and disclose your Personal, Analytics, and Site Visit Information: (i) to investigate a possible crime, such as fraud or identity theft; (ii) in connection with the sale, purchase, merger, reorganization, liquidation or dissolution of MARCHON Supplements; (iii) when we believe it is necessary to protect the rights, property, or safety of R.A.D® or other persons; or (iv) as otherwise required or permitted by law, including any contractual obligations of MARCHON Supplements.

CAN I CHOOSE TO STOP RECEIVING MARKETING MESSAGES THAT INFORM YOU ABOUT OUR NEWS AND OFFERS THAT YOU MAY LIKE

As part of our service, we will email you with Supplement news, new products and offers that we have for our customers.  If you do not wish to receive this additional information, you can; opt out at point of sale, choose the ‘opt out/unsubscribe’ option present on our email, reply STOP or UNSUBSCRIBE to any email/text contact. As a previous customer, we may contact you up to 24 months after your purchase. You can ‘unconsent’ to contact at any time choosing the ‘opt out/unsubscribe’ option present on our email, reply STOP or UNSUBSCRIBE to any email/text contact.

You can delete, change, or update your Personal Information at any time by contacting us support@marchon.co.uk. We may require you to provide certain information to verify that it is you making the request. However, note we will not delete information that we are required to retain in order to comply with applicable laws and regulations, or that we are required to retain in order to complete transactions with you.

TO IMPROVE OUR SERVICES, FOR ADMINISTRATION PURPOSES AND TO PROTECT OUR BUSINESS INTERESTS

The business purposes for which we will use your information include accounting, budgeting, billing and audit, credit or other payment card verification, safety, security, statistical and marketing/profiling analysis, systems testing, maintenance, ordering of supplies, planning and development.

DATA TRANSFERRED OUTSIDE THE EU

Some of the companies we use for our apps are situated in third countries; therefore some data may be transferred to countries outside the European Economic Area (EEA).  Transfers of data to these companies are either on the basis of adequacy, or subject to appropriate safeguards.

We are committed to taking appropriate technical and organisational measures to protect your personal data against unauthorised or unlawful processing and against accidental loss, destruction or damage to personal data.

Where MARCHON discloses your personal data to a third party, we require them to have appropriate technical and organisational measures in place to protect your personal data; however in some instances we may be compelled by law to disclose your personal data to a third party, over which we have limited control.

MARCHON™ Supplements are committed to protecting your privacy. This SMS Privacy Policy explains how we collect, use, and protect the information you provide when you opt in to receive SMS communications from us.

1. Information We Collect

When you subscribe to our SMS service, we may collect the following information:

  • Information related to your interaction with our SMS messages (e.g., message delivery and read receipts)

We do not collect any personal information through SMS other than the phone number you provide.

OTHER

We have partnered with various technologies: Heroku, Mixpanel, Rudderstack, Stripe, Revenuecat, Google and Firebase, and we reserve the right to add other services when appropriate, to offer members the opportunity to enhance their training experience.  Use of these services is optional and you are in control of your data via use of the APP (see the service provider’s privacy notice for more information).  MARCHON can only view the data you give us permission to and communicate with you via the APP (if permission is given) eg to invite you to join Gym challenges.

SPECIAL CATEGORIES OF PERSONAL DATA

In the course of providing services to you, we may collect information that is considered “special categories of personal data” eg completion of a health questionnaire. We only collect this information where you have given your explicit consent, it is necessary to protect your vital interests, or you have deliberately made it public. If you do not allow us to process any special category personal data, this may mean we are unable to provide all or parts of the services you have requested from us.

HOW AND WHY WE USE YOUR PERSONAL DATA

To fulfil contractual obligations and provide our services to you. Training membership is a contract between MARCHON and each individual member, so we require your personal data in order to issue you a membership unique to you, to allow you APP access and enable us to verify your identity when necessary.

TO COMMUNICATE WITH YOU AND MANAGE OUR RELATIONSHIP WITH YOU

We may need to contact you by email, phone, letter and/or SMS for administrative, customer service or operational reasons, please be aware that these communications are not made for marketing purposes and as such, you will continue to receive them even if you choose not to receive marketing communications.  Examples of these include; changes to pricing structure or unplanned Training closures.

Your opinion is very important to us, so we may send you an email or SMS to seek your feedback.We will use the communications you exchange with us and the feedback you may provide in order to manage our relationship with you as our customer and to improve our services and experiences for other members.

TO PERSONALISE AND IMPROVE YOUR CUSTOMER EXPERIENCE

We may also collect information on how you use our website, which pages of our website you visit most, what services you use/purchase, in order to understand what you like. We may use this information to tailor the content and offers that you see on our website and to send you relevant messages that we think you might like.

To raise awareness and enable you to share your achievements with others, we post photos and/or videos on social media, of any special events or challenges that we organise.  Please be aware that if you take part, you may be included in these.
